面積測量開發商說了算? 律師:業主可申請糾正

六年前,張先生等數十人購買了南城某高檔住宅社區的別墅產品,當時簽訂協議時以一萬五千元上下不等的價格商定。收樓入住后不久,開發商方面突然向每戶購樓者發來通知,聲稱當初面積丈量有誤。如今每戶業主需要補交五萬元左右的面積差價,否則不予辦理房產證。不得已,所有業主只好補交。然而,有部分業主隨后請來專業測繪機構丈量后表明,實用面積并無差異,開發商是將公共面積分攤到了業主頭上,并以不予辦證為要挾,屬于單方面強行征收。

張先生等業主問:如今房產證已經發放,但是實際房屋面積小于產權證填寫的面積,且每戶已經被開發商無理收取五萬元左右房款,業主如何解決這一問題?

廣東寶威律師事務所唐勝利律師:業主們需要聘請有資質的專業測繪公司現場丈量精確面積并且出具報告,然后向所屬房管部門申請修正房產證面積,并糾正開發商的錯誤做法。一旦房產證面積得到修正,開發商即需要退換不當得利。
