親屬代持房產 糾紛如何維權?

由于年齡超過五十歲,按揭申請受阻,南城王女士五年前在購買一套住宅物業時,與已經出嫁的女兒達成協議:以女兒名義購房,并申請辦理按揭手續。協議表明,購房首付資金和后續按揭均由母親王女士負擔,女兒只是名義上的持有人。不料,去年女兒生意不順,打算將母親正在按揭中的房屋二次抵押辦理融資,王女士知道后反對,但是在程序上卻無法阻止女兒。王女士問,自己如何才能阻止女兒利用這套房屋進行二次抵押?

廣東寶威律師事務所唐勝利律師:從法律上來說,王女士無法直接阻止女兒利用房屋融資抵押。但是,王女士可以利用母女當初簽訂的協議書,直接向法庭申請索回產權登記。在法院受理期間,還可以申請查封凍結該房屋的一切融資抵押行為,直到法院判決下達。
